Photos: We may collect photos that you've taken with your camera while using our app, as well as photos you upload from your device to our app. Please note that you will not be able to upload content from your camera unless we can access your device's camera. 

 

Videos: We may collect videos that you've taken with your camera while using our app, as well as videos you upload from your device to our app. Please note that you will not be able to upload content from your camera unless we can access your device's camera.

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Data"). Personally identifiable information may include, but is not limited to:

We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information. 2.Use of Data

Creafy will not use your videos or photos for any purpose other than to provide you with Creafy's dialogue and video production functions. Creafy will never use your videos or photos for face recognition, as Creafy does not utilize face recognition technology or any other means of processing biometric data to uniquely identify or verify the identity of users.

 

Creafy uses the collected data for various purposes:

l  To provide and maintain our Service

l  To notify you about changes to our Service

l  To allow you to participate in interactive features of our Service when you choose to do so

l  To provide customer support

l  To gather analysis or valuable information so that we can improve our Service

l  To monitor the usage of our Service

l  To detect, prevent and address technical issues

 

Uploaded content will be collected and displayed in the library for users to reuse and to facilitate the use of the service. This content will be stored on your device and in the cloud for a period of time, and will be specifically displayed to you during your use of the service. By uploading this content, you are specifically agreeing to our collection and storage of it as described here. Creafy will never use your uploaded content for facial recognition, as it does not use any technology to process biometric data for the unique identification or verification of users. 

 

If Creafy decides to change the aforementioned processing purposes, we will inform you of these changes before using your personal information within the scope of the newly established purpose, and if required by applicable law, we will seek your consent separately.

 

Legal Basis for Processing Personal Data under the General Data Protection Regulation (GDPR)

If you are from the European Economic Area (EEA), Creafy legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

Creafy may process your Personal Data because:

l  We need to perform a contract with you

l  You have given us permission to do so

l  The processing is in our legitimate interests and it is not overridden by your rights

l  To comply with the law

3.Data Sharing

We will never sell any personal information to third parties, but will only share when required to carry out legal business functions.

 

We will not rent, sell, or share your data (including photos, videos) with any third party outside our company or its affiliated companies. We will not use your personal data to train and/or create separate artificial intelligence/products.

 

We will not share, transfer, or disclose your personal information in violation of this policy or applicable law. If we may undergo a merger, spin-off, acquisition, asset sale, or bankruptcy liquidation that could lead to an information transfer, we will require the successor to protect your personal information in accordance with laws and regulations and at a standard that is no lower than the one stipulated by this policy.

4.Retention of Data

The duration Creafy stores your data will not exceed the time required for data processing purposes. Therefore,

 

- Your photos and videos will be stored on Creafy's servers until you complete editing. After editing is finished, this data will be immediately deleted from our servers. The rest of the time, photos and videos used in the Creafy application will be stored on your mobile device locally, and you can delete them at any time by directly deleting these photos and videos from your mobile device's file system or by deleting the Creafy application.

 

- Anonymous, aggregated, or de-identified data will be stored until Creafy achieves the purposes stipulated in this Privacy Policy.

 

Data security. Creafy uses computers and/or other IT support tools to process your data. Creafy takes technical and organizational measures to ensure the information is processed in an appropriate and secure way, including preventing unauthorized or unlawful processing as well as accidental loss, destruction, or damage. For example, Creafy uses verified contractors who may have access to the data stipulated in Article 2 of the privacy policy related to the data processing agreement signed with Creafy. We also guide and train our employees to process your data securely according to our internal data protection policy.

 

Creafy will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.

Creafy will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

5.Transfer of Data

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside United Kingdom and choose to provide information to us, please note that we transfer the data, including Personal Data, to United Kingdom and process it there.

Creafy will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

6.Right to Information

You have the right to access your personal data processed by Creafy App and enjoy the right to data portability. This means that you can inquire which of your personal data is processed by Creafy. You may also request clarification on such information, such as the purpose of collection and processing, the processing period, and which third parties have the right to access the information. You have the right to request Creafy to provide your personal data in a structured, commonly used, and machine-readable format. If the processing is based on your consent or contract, and the processing is carried out by automated means, you also have the right to transmit this data to another controller.

 

You have the right to ask Creafy to rectify your personal data.

This means that you can request the correction of all inaccurate personal data related to you.If you believe it is necessary, you may also supplement your personal data.

 

You have the right to ask Creafy to delete personal data

If the processing of personal data is no longer necessary for achieving the purpose of collecting personal data, or there is no legal basis for processing personal data, you can request Creafy to delete personal data.

 

You have the right to limit Creafy's processing of your personal data

In certain circumstances, according to the law, you will be able to restrict the processing of your personal data, for example, if you object to the accuracy of the personal data being processed, or if Creafy no longer has an interest in processing your personal data, but you wish Creafy to do so for different reasons, such as making a claim on behalf of someone, and will not delete the information, but only limit it.

 

You have the right to withdraw your consent

You may revoke your approval for Creafy to collect and process your personal data at any time by contacting us. The legality of processing based on consent before withdrawal will not be affected. Upon receiving such withdrawal request from you, we will promptly process it, and unless otherwise required by law, we will no longer process your personal data.

 

You have the right to object to Creafy processing your personal data

In certain circumstances, according to the applicable laws, you can object to the processing of your personal data.

 

When processing is related to your personal data, you have the right to object to the processing of your personal data; or when we process your data to pursue our legitimate interests or those of a third party, you have the right to object to the processing of your personal data.

 

If you submit a request to object to processing, we will no longer process personal data unless we can demonstrate compelling legitimate grounds for the processing.

 

Please note that if your personal data is used for direct marketing purposes, you have the right to object at any time without providing any reason. We will no longer process your data for such direct marketing purposes. We may employ third party companies and individuals to facilitate our Service ("Service Providers"), provide the Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used.

Our Service may contain links to other sites that are not operated by us. If you click a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

 

11.Payment Information

Our e-commerce provider, Apple is responsible for processing your personal information, including billing, processing and managing in-app purchases. They ensure that your information is absolutely secure and reliable. The processing of this information is part of the contract between us. Please note that we cannot access or use your credit or debit card information.

12.Children's Privacy

Our Service does not address anyone under the age of 18 ("Children").

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the "effective date" at the top of this Privacy Policy.
